Chuss v. Redner’s Markets, Inc. (E.D. Pa.)

Overtime: Deli, Meat, and Produce Managers

On August 15, 2024, Plaintiff Chuss (a former Meat Manager) filed a federal lawsuit as a potential class/collective action in the U.S. District Court for the Eastern District of Pennsylvania on behalf of himself and all other grocery department (Deli, Meat, and Produce) managers, asserting that Redner’s Markets, Inc. violated federal and state law by requiring him and other salary-paid grocery department (Deli, Meat, and Produce) managers to work in excess of 40 hours per workweek while denying him and others overtime compensation allegedly required by law. In late 2024, Redner’s began paying those grocery department manager positions overtime compensation for hours worked going forward, but not retroactively. This case seeks back pay for unpaid overtime, and any allowed interest and/or liquidated damages, for the applicable potential recovery period prior to that change, during which Redner’s paid those positions by salary and treated those positions as if they were ineligible for overtime pay.

The lawsuit’s allegations, which Plaintiff will have to prove at a trial, seeks unpaid overtime on behalf of all Deli, Meat and Produce Managers who worked in one of those salary-paid positions for Redner’s at any time within the last three years. Defendant Redner’s Markets has filed its Answer and denies that it is liable for any unpaid overtime to Plaintiff or others similarly situated.
